1. Introduction
This Terms of Service Agreement (“Agreement,” “Terms,” or “Contract”) sets forth the entire understanding between Wilde Detailing, LLC, a California limited-liability company (“Wilde Detailing,” “Company,” “Platform,” “we,” “us,” or “our”), and any individual or entity utilizing or accessing its website, scheduling portal, digital booking forms, payment interfaces, or related communications systems (“Customer,” “User,” “you,” or “your”). By accessing the Platform, initiating a booking, submitting payment, or permitting a service to be performed, you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety. These Terms supersede all prior verbal or written communications concerning the services.
Wilde Detailing operates within the State of California and provides a digital environment through which customers may request, schedule, and pay for mobile vehicle detailing services delivered by independent third-party contractors. The Platform functions as an intermediary marketplace and technology facilitator only and is not itself a provider of vehicle cleaning, restoration, or mechanical work.
2. Definitions
For interpretive consistency, the following terms shall have the meanings indicated below, whether singular or plural, capitalized or not:
- • “Platform” means all websites, mobile sites, booking engines, forms, APIs, or integrated third-party applications operated or licensed by Wilde Detailing for the purpose of advertising, scheduling, or transacting vehicle-detailing services.
- • “Technician” refers to any independent contractor, subcontractor, vendor, or entity engaged to perform services booked through the Platform, whether or not certified by the International Detailing Association (“IDA”).
- • “IDA-Certified Technician” means an independent detailing professional who holds active certification, training recognition, or membership with the IDA; such certification is marketing identification only and does not constitute a warranty of capability or performance.
- • “Services” means mobile vehicle washing, interior and exterior cleaning, waxing, polishing, coating, vacuuming, or related cosmetic procedures performed on Customer’s vehicle.
- • “Customer” or “User” denotes the individual or legal entity initiating a booking through the Platform or on whose behalf such booking is made.
- • “Booking” means a confirmed order for Services following successful payment authorization.
- • “Site Conditions” means the physical premises, driveway, street, or garage where Services are to be performed.
- • “Independent Contractor” has the meaning assigned under California Labor Code § 2750.3 and related authorities.
Interpretive principles: headings are for convenience only; singular includes plural and vice versa; “including” means “including without limitation.”
3. Role of Wilde Detailing and Nature of Relationship
Wilde Detailing functions solely as a booking, payment-processing, and customer-support intermediary. The Company does not supervise, employ, or control Technicians and expressly disclaims any employment, agency, partnership, or joint-venture relationship. Technicians retain exclusive discretion regarding methods, materials, sequence, and workmanship. Customers acknowledge that Wilde Detailing is not the employer, principal, or insurer of any Technician and bears no responsibility for the acts or omissions of such parties.
Where practicable, Wilde Detailing may assign or refer Services to Technicians who maintain IDA certification or similar professional credentials; however, availability varies by region, schedule, and demand. No representation, guarantee, or condition is made that any specific or certified Technician will be dispatched for any booking. Assignments may be subcontracted, re-delegated, or re-scheduled at Wilde Detailing’s sole discretion without notice.
4. Eligibility and Customer Representations
By initiating a booking, you represent and warrant that you: (a) are at least eighteen (18) years of age and legally competent to contract; (b) are the registered owner, lessee, or authorized custodian of the subject vehicle; (c) possess authority to grant access to the Site Conditions; (d) will provide true, accurate, and complete information; and (e) will comply with all applicable laws, ordinances, and parking regulations during the performance of Services. You further represent that you maintain appropriate vehicle insurance and understand that Wilde Detailing’s role is limited to facilitating independent contractors. You release and waive any claim against Wilde Detailing arising from inaccurate or incomplete information you provide.
5. Booking and Service Process
A booking is deemed confirmed only upon receipt of payment authorization through the Platform’s payment processor. Technicians are assigned based on geographic proximity, skill category, and availability. Wilde Detailing does not guarantee arrival times or completion within estimated durations. All time windows are approximations subject to traffic, weather, and operational variables. Additional or upgraded work requested after booking constitutes a separate transaction and requires prior approval and payment through the Platform. Wilde Detailing reserves the right to decline any service request that falls outside its published scope or that, in its judgment, presents unsafe, unlawful, or impractical conditions.
6. Pricing, Payments, and Authorization
All displayed prices are denominated in U.S. Dollars and may include service fees, surcharges, or local taxes. By providing a credit or debit card, Customer authorizes Wilde Detailing and its payment processors (including Stripe or successors) to place a hold, capture, or charge the designated account for the full amount of the booking, plus any add-on selections, gratuities, or incidentals approved via the Platform. No off-platform or cash transactions are permitted; engaging in such conduct constitutes a material breach that waives any protections, warranties, or dispute-resolution benefits afforded by Wilde Detailing. Refunds, when approved, shall be processed solely through the original payment channel and in accordance with processor timelines (typically five to ten business days). Wilde Detailing disclaims liability for banking or intermediary delays.
7. Customer Responsibilities and Site Conditions
Customer shall ensure that the service area is lawful, safe, and accessible for the duration of the appointment, including but not limited to adequate lighting, space clearance, and absence of hazards. Customer must remove all valuables and personal effects from the vehicle prior to commencement. Wilde Detailing and its Technicians are not responsible for lost, misplaced, or damaged personal property left inside the vehicle. Customer agrees to indemnify and hold harmless Wilde Detailing from any injury or damage occurring on the Customer’s premises except to the extent caused by the gross negligence or willful misconduct of Wilde Detailing itself. If local regulations restrict mobile washing, the Customer bears responsibility for securing necessary permission or water-use compliance.
8. Access, Power, and Water Requirements
Unless a designated “waterless” package is selected, Customer shall provide a functional outdoor water spigot with standard pressure and a GFCI-protected electrical outlet within fifty (50) feet of the service area. Wilde Detailing and Technicians assume no responsibility for plumbing failures, pressure fluctuations, leaks, sediment, circuit interruptions, or any resulting property damage except in cases of gross negligence. If required utilities are unavailable or unsafe upon arrival, the appointment may be cancelled or rescheduled at the Technician’s discretion, and Customer may be charged a cancellation or travel fee.
9. Pre-Service Inspection, Evidence, and Consent
Customer grants permission for Wilde Detailing and its Technicians to document the vehicle and surrounding work area through photographs or video before, during, and after the service. Such documentation constitutes conclusive evidence of condition for quality assurance and dispute resolution and remains property of Wilde Detailing. Any alleged damage must be reported in writing with timestamped photographs within twenty-four (24) hours of service completion; otherwise, the claim shall be deemed waived. Photographs supplied by Wilde Detailing shall prevail in any conflict of evidence. Separate written consent is required for use of media in public marketing or social content.
10. Service Duration, Delays, and Force Majeure
Service duration estimates are non-binding. Neither Wilde Detailing nor Technicians shall be liable for delay or failure to perform caused by weather conditions, traffic, illness, supply shortage, mechanical failure, labor dispute, act of God, natural disaster, or governmental restriction. In such cases, Wilde Detailing may reschedule or cancel without penalty. No consequential damages shall arise from delay, cancellation, or rescheduling. Customer’s exclusive remedy is a refund or credit of prepaid amounts, if applicable.
11. Vehicle Condition and Mechanical Disclaimers
Customer acknowledges that certain vehicle materials—including oxidized clearcoat, fragile trim, aftermarket wraps, and aged interiors—are inherently susceptible to wear during cleaning. Wilde Detailing and Technicians are not responsible for existing defects or for incidental contact with failing components such as sensors, electronics, or mechanical assemblies. No guarantee is made regarding stain removal, odor elimination, or aesthetic outcome. Services are cosmetic only and do not constitute mechanical repair. Battery drain, alarm activation, or ECU faults occurring during or after service are deemed coincidental unless proven by clear evidence of Technician misconduct.
12. Customer-Supplied Products
If Customer provides specific products or chemicals, such use shall be at Customer’s sole risk. Wilde Detailing disclaims all responsibility for compatibility, safety, or performance of such materials. Any manufacturer warranty or product liability claim must be directed to the product supplier. Wilde Detailing’s limited warranty is void when non-standard materials are used at Customer’s request.
13. Technician Assignment, IDA Certification, and Subcontracting
Wilde Detailing may, in its sole discretion, allocate work orders to available Technicians based on geography, expertise, or scheduling efficiency. Assignments may involve IDA-certified professionals or unaffiliated independent contractors. Certification status is referenced for marketing and industry-recognition purposes only and does not constitute a representation of particular skill, guarantee, or outcome. Wilde Detailing reserves the unrestricted right to subcontract, substitute, or rotate Technicians and to cancel or reassign a booking if required by operational necessity. Customer acknowledges that such substitutions do not affect the validity of these Terms or the enforceability of payments made.
14. Indemnification and Hold-Harmless
Customer shall defend, indemnify, and hold harmless Wilde Detailing, its affiliates, successors, officers, directors, employees, contractors, and agents from and against any and all claims, actions, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to:
- (a) Customer’s breach of these Terms;
- (b) any inaccurate representation or omission in information provided by Customer;
- (c) damage, injury, or loss occurring on the premises where Services are performed (except to the extent caused solely by Wilde Detailing’s gross negligence);
- (d) Customer-supplied products or materials; or
- (e) any unlawful or unsafe condition created or permitted by Customer.
This indemnity shall survive completion or termination of any Service and shall apply to claims brought by third parties as well as by Customer.
15. Limitation of Liability and Warranty Disclaimer
Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, Wilde Detailing disclaims all express, implied, statutory, or other warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, or error-free operation.
Neither Wilde Detailing nor any Technician shall be liable for indirect, incidental, consequential, exemplary, or punitive damages of any kind—including diminished vehicle value, lost profits, emotional distress, or loss of use—even if advised of the possibility thereof.
Wilde Detailing’s total cumulative liability, whether in contract, tort, or otherwise, shall not exceed the greater of (a) one hundred dollars (US $100) or (b) the amount actually paid by Customer for the specific Service giving rise to the claim. No action may be brought more than one (1) year after the cause of action accrues. Nothing herein limits liability that cannot lawfully be limited under Cal. Civ. Code § 1668 (gross negligence, fraud, or willful misconduct).
16. Cancellation, Rescheduling, No-Show, and Refunds
Customer may cancel or reschedule a booking with at least twenty-four (24) hours’ notice for a full refund. Cancellations within 24 hours or failure to provide timely access constitute a late cancellation and are non-refundable.
If a Technician or Wilde Detailing cancels for operational reasons, Customer will receive a full refund or credit. Refunds are processed through the original payment method and subject to processor timelines. Wilde Detailing may withhold administrative fees for repeated short-notice cancellations.
17. Dispute Resolution, Arbitration, and Class-Action Waiver
Any dispute, claim, or controversy arising from or relating to these Terms or the Services shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, before a single arbitrator seated in Los Angeles County, California. The Federal Arbitration Act, 9 U.S.C. §§ 1–16, governs interpretation and enforcement of this clause. Judgment on the award may be entered in any court of competent jurisdiction.
Customer waives the right to trial by jury and to participate in any class, collective, or representative action. Each dispute shall be conducted solely on an individual basis. Notwithstanding the foregoing, Wilde Detailing may seek temporary or permanent injunctive relief in state or federal court to protect intellectual property, trade secrets, or to prevent fraud or data abuse.
18. Governing Law and Venue
This Agreement and all disputes are governed by and construed under the laws of the State of California, without regard to its conflict-of-law principles. Subject to mandatory arbitration, any permitted court proceeding shall occur in the state or federal courts located in Los Angeles County, California, and the parties consent to personal jurisdiction therein.
19. Communications Consent (SMS & Email)
By providing contact information, Customer authorizes Wilde Detailing to send transactional messages, confirmations, reminders, and updates via SMS, MMS, or email. Message and data rates may apply. Reply STOP to opt out; HELP for assistance. Marketing or promotional communications require separate opt-in consent. Wilde Detailing complies with the Telephone Consumer Protection Act (47 U.S.C. § 227 et seq.) and related FCC rules.
20. Privacy and Data Use (CCPA Notice)
Wilde Detailing collects and processes limited personal information to schedule and complete bookings. The Company does not sell personal data as defined in the California Consumer Privacy Act (Cal. Civ. Code §§ 1798.100–1798.199). Customers may request disclosure or deletion of stored information by emailing support@wildedetailing.com.
All data transmissions occur over encrypted connections where available; however, no system is entirely secure, and Wilde Detailing disclaims liability for unauthorized access beyond its reasonable control.
21. Intellectual Property and Ownership of Content
All trademarks, trade names, logos, software code, photographs, text, and designs appearing on the Platform are owned by or licensed to Wilde Detailing. Copying, reproducing, redistributing, or reverse-engineering any portion of the Platform without written authorization is prohibited.
Customers grant Wilde Detailing a perpetual, royalty-free license to use anonymized feedback, reviews, or images voluntarily provided for marketing or quality purposes.
22. Prohibited Conduct
Users shall not:
- (a) engage in off-platform transactions;
- (b) harass, threaten, or interfere with Technicians or staff;
- (c) circumvent payment mechanisms;
- (d) upload malware or misuse the Platform; or
- (e) submit defamatory or fraudulent reviews.
Violation may result in suspension or permanent denial of service, without refund.
23. Modifications to Terms
Wilde Detailing may revise these Terms at any time by posting an updated version on the Platform with a new “Effective Date.” Continued use after posting constitutes acceptance. Material changes affecting dispute-resolution rights will apply prospectively only.
24. Severability, No Waiver, and Attorney Fees
If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. No waiver of any breach shall be deemed a waiver of any other or subsequent breach.
In any arbitration or judicial proceeding arising from these Terms, the prevailing party shall be entitled to recover reasonable attorney fees and costs.
25. Entire Agreement and Acknowledgment
These Terms, together with any incorporated policies (Privacy Policy, Booking Guidelines, etc.), constitute the entire understanding between Wilde Detailing and Customer. They supersede all prior oral or written agreements. Headings are for reference only. Obligations relating to payment, liability, indemnification, dispute resolution, and privacy shall survive termination.
By proceeding with a booking, Customer acknowledges having read and understood this Agreement and voluntarily agrees to be bound.
